Welcome to The Muddy Raccoon Pottery (“Studio”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website located at www.Themuddyraccoon.com (the “Site”) and your participation in our classes, workshops, events, and purchases of physical merchandise.
By accessing our Site, purchasing merchandise, or registering for any class or event, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
1. Studio Rules & Safety Liability
Pottery involves inherent risks, including the use of sharp tools, heavy equipment, and exposure to dust and high-temperature kilns.
- Safety Compliance: You agree to follow all safety instructions, studio guidelines, and staff directions.
- Waiver of Liability: By participating in studio activities, you voluntarily assume all risks of injury or property damage. You agree to release The Muddy Raccoon Pottery from any liability to the fullest extent permitted by law.
- Right to Remove: We reserve the right to remove any participant from a class or event without a refund if their behavior is unsafe, disruptive, or disrespectful to staff or other community members.
2. Class, Workshop, and Event Registrations
- Booking & Payment: All class and event registrations must be paid in full at the time of booking through our online system.
- Cancellation & Refund Policy:
- All sales are final.
- No refunds will be given. Studio credit may be discussed on a case-by-case basis.
- Missed Classes: We do not offer make-up sessions, refunds, or credits for individual classes missed within a multi-week course.
- Studio Cancellations: If we must cancel a class due to low enrollment, staff illness, or emergencies, you will receive a studio credit or the option to reschedule.
3. Production, Firings, and Unclaimed Work
- Firing Results: Pottery is an unpredictable art form. The Studio is not responsible for pieces that crack, warp, break, or experience glaze defects during drying or firing.
- Storage Limits: All finished pieces must be picked up within [e.g., 30 days] of the final firing date.
- Disposal of Property: Any artwork or personal property left unclaimed after the storage window will become property of the Studio and may be discarded, recycled, or sold to clear shelf space.
4. Merchandise Purchases & E-Commerce
- Product Descriptions: We make every effort to display the colors and textures of our ceramic merchandise and supplies accurately. However, handmade items vary naturally, and we cannot guarantee your screen display will perfectly match the physical item.
- Shipping & Delivery: Shipping fees and estimated delivery timelines will be calculated at checkout. We are not responsible for delays caused by shipping carriers.
- Returns & Exchanges: no refunds/returns all sales final.
5. Intellectual Property
- Our Content: All text, graphics, logos, images, and website code are the property of The Muddy Raccoon Pottery and are protected by copyright laws.
- Your Content & Photography: We occasionally take photos or videos during classes for social media and marketing. By participating, you grant us permission to use your likeness. If you prefer not to be photographed, please inform studio staff before your session begins.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any legal actions must be filed in the courts located in Cumberland County/Crossville.
7. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted directly to this page with an updated “Last Updated” date. Continued use of our Site or services constitutes acceptance of the revised Terms.
